1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and KrisCodes2 LLC ("Lifted CV," "we," "us," or "our"), governing your access to and use of the Lifted CV website at liftedcv.com and all related services, features, and applications (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any modification constitutes acceptance of the modified Terms.

2. Description of Service

Lifted CV is an AI-powered platform that provides the following services:

  • Resume creation, editing, enhancement, and export
  • AI-assisted resume optimization and tailoring
  • Job search aggregation from third-party job boards and APIs
  • Job-to-resume matching and recommendations
  • Salary research and compensation data
  • ATS (Applicant Tracking System) compatibility analysis
  • Cover letter generation

The Service is provided "as is" and "as available." We make no guarantees regarding the availability, accuracy, or completeness of the Service and reserve the right to modify, suspend, or discontinue any feature at any time without prior notice.

3. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4. Account Registration and Security

  • You must provide accurate, current, and complete information during registration and keep your account information up to date.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You must notify us immediately at hr@liftedcv.com if you suspect unauthorized access to your account.
  • Each account is for a single individual user. Account sharing is not permitted.
  • We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

5. Subscriptions and Payment

5.1 Free and Paid Plans

Lifted CV offers a free tier with limited features and paid subscription plans (Pro and Premium) with enhanced capabilities. Details of each plan are available on our Pricing page.

5.2 Billing and Auto-Renewal

Paid subscriptions are billed on a recurring basis (monthly or annually, as selected at checkout). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us to charge the payment method on file for each renewal period.

5.3 Payment Processing

All payments are processed by Stripe, Inc. By subscribing, you agree to Stripe's Terms of Service. We do not store your full payment card details on our servers.

5.4 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until your current billing period expires. No pro-rated refunds are issued for partial billing periods.

5.5 Refunds

If you are unsatisfied with the Service, you may request a full refund within 14 days of your initial purchase or renewal. To request a refund, email hr@liftedcv.com with the subject line "Refund Request." Refunds are processed to the original payment method within 5-10 business days.

5.6 Price Changes

We reserve the right to modify subscription prices. We will provide at least 30 days advance notice before any price increase takes effect. Price changes apply at the start of the next billing period following the notice period.

6. Acceptable Use Policy

You agree not to use the Service to:

  • Create fraudulent, misleading, or deceptive resumes or professional profiles, including impersonating another person.
  • Use automated scripts, bots, scrapers, or other automated means to access the Service.
  • Attempt to decompile, reverse engineer, or extract the source code of the Service.
  • Circumvent, disable, or interfere with security features of the Service.
  • Upload malware, viruses, or harmful code.
  • Resell, redistribute, or sublicense the Service or any part thereof without our written consent.
  • Use the Service to harass, threaten, or defame any person.
  • Use the Service content (including job listings, salary data, or resume templates) to train AI or machine learning models without our express written permission.
  • Share your account credentials with others or operate multiple accounts.
  • Violate any applicable local, state, national, or international law.

We reserve the right to suspend or terminate your account without notice if you violate this Acceptable Use Policy.

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including its software, design, resume templates, algorithms, UI/UX, documentation, branding, logos, and all associated content, is the exclusive property of KrisCodes2 LLC and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use in accordance with these Terms.

7.2 Your Content

You retain all ownership rights in the resume content, professional information, and other materials you create or upload to the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive, royalty-free license to host, store, display, and process Your Content solely for the purpose of providing and improving the Service. This license terminates when you delete Your Content or your account, subject to backup retention periods described in our Privacy Policy.

We do not use Your Content to train AI models, sell to third parties, or share with other users without your explicit consent.

8. Job Search and Salary Data Disclaimers

Lifted CV is not an employment agency, staffing firm, or recruiter. We aggregate publicly available job listings from third-party sources for your convenience. We do not:

  • Guarantee the accuracy, completeness, or timeliness of any job listing.
  • Guarantee that any job listing is currently active or that the employer is actively hiring.
  • Verify the legitimacy of employers or job postings.
  • Make any employment, hiring, or salary decisions on your behalf.
  • Guarantee that using our Service will result in job interviews, offers, or employment.

Salary data provided through the Service is sourced from publicly available information and third-party data providers. Salary figures are estimates and should not be relied upon as guarantees of compensation. Actual compensation depends on many factors outside our control, including employer policies, location, experience, negotiation, and market conditions.

AI-generated resume suggestions are provided as recommendations only. You are solely responsible for reviewing, verifying, and approving all content in your resume before submitting it to any employer.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT, INCLUDING JOB LISTINGS, SALARY DATA, OR AI-GENERATED SUGGESTIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KRISCODES2 LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITY, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).

11. Indemnification

You agree to indemnify, defend, and hold harmless KrisCodes2 LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights, including intellectual property or privacy rights.

12. Third-Party Services and Links

The Service may contain links to or integrate with third-party websites, services, and APIs (including job boards, payment processors, and authentication providers). These third-party services are governed by their own terms and privacy policies. We are not responsible for the content, accuracy, availability, or practices of any third-party service. Your use of third-party services is at your own risk.

13. Termination

You may terminate your account at any time by contacting us at hr@liftedcv.com or through your account settings. Upon termination, your right to use the Service ceases immediately, and we will delete your account data in accordance with our Privacy Policy.

We may suspend or terminate your account at any time, with or without cause and with or without notice, if we reasonably believe you have violated these Terms. Sections 7, 9, 10, 11, 14, and 15 survive termination of these Terms.

14. Dispute Resolution and Arbitration

14.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at hr@liftedcv.com and attempt to resolve the dispute informally for at least 30 days.

14.2 Binding Arbitration

If the dispute cannot be resolved informally, you and KrisCodes2 LLC agree to resolve the dispute through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in the English language. The arbitrator's decision will be final and binding.

14.3 Class Action Waiver

YOU AND KRISCODES2 LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

14.4 Opt-Out

You may opt out of this arbitration agreement by sending written notice to hr@liftedcv.com within 30 days of creating your account. If you opt out, disputes will be resolved in court as described below.

14.5 Small Claims Exception

Either party may bring an individual action in small claims court in the state where you reside (or in Delaware) if the claim qualifies, as an alternative to arbitration.

15. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. If a dispute is not resolved through arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

16. General Provisions

  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • Entire Agreement: These Terms, together with our Privacy Policy, Cookie Policy, and Copyright Notice, constitute the entire agreement between you and KrisCodes2 LLC regarding the Service.
  • Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • Force Majeure: We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or Internet disruptions.
